It depends on whether the tree has a Tree Preservation Order (TPO) or is within a conservation area. A TPO is a formal designation by the local authority that protects a specific tree — no felling or significant pruning is permitted without written consent from South Ayrshire, East Ayrshire or North Ayrshire Council. TPO registers are public documents and John checks these before any work starts. In conservation areas, all trees above a certain size (generally with a trunk diameter over 75mm at 1.5m height) are automatically protected — you must give the council 6 weeks’ written notice before carrying out significant work, giving them the opportunity to apply a TPO if they wish. For trees with no protection in a private garden, no permission is required for work that doesn’t affect a protected tree. John will identify any TPO or conservation area restrictions at the free site visit and won’t proceed with protected trees until correct consent is in place.
Most crown work can be carried out year-round in Ayrshire, but late autumn to early spring — roughly November to March — is generally the preferred window for deciduous trees. With the leaves off, the branch structure is fully visible, cuts are easier to assess and the tree heals readily when growth resumes. Summer pruning is possible but the canopy makes assessment harder and wounds close more slowly. There’s also a wildlife consideration that John takes seriously: most bird species in Ayrshire nest between March and August, and disturbing an active nest is an offence under the Wildlife and Countryside Act 1981. Before any significant work on a leafy tree in nesting season, John checks for active nests — if nesting activity is found, work is rescheduled to avoid the nest. Emergency work (hazardous or storm-damaged trees) is carried out whenever necessary regardless of season, with appropriate care taken.
If a tree is visibly leaning after a storm, has a large limb hanging, or has come down, the priority is safety. Cordon off the area and keep people away from it until it’s been assessed by a professional — a partially fallen tree is often under tension and more unpredictable than one already on the ground. At the visit he’ll assess whether the hazard needs immediate removal or can be made safe and dealt with in planned time.
